These Terms of Service (“Terms”) are an agreement between you and Advisory Apps Sdn. Bhd. (“we”, “us”) governing your use of the Kingsguard TD: Heroes & Magic website (kingsguardtd.com), launch alerts, and the Kingsguard TD: Heroes & Magic mobile game and its online features (together, the “Services”). Please read them carefully.

1. Acceptance of these terms

By accessing or using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services. If you use the Services on behalf of someone under the age of majority, you confirm that you are their parent or legal guardian and accept these Terms on their behalf.

2. Eligibility & accounts

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Services. If you are under the age of majority, you need permission from a parent or guardian.
You are responsible for your device, your account and any activity on it. Keep your login credentials safe and tell us promptly if you suspect unauthorised use.
Player names must not impersonate others or contain offensive, misleading or infringing content. We may change or remove names that break these Terms.

3. Your licence to play

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the Game on devices you own or control, for your own non-commercial entertainment. All rights not expressly granted are reserved by us and our licensors.

4. Pre‑registration & launch

Launch alerts and pre-registration let you express interest in the Game. They do not create an obligation for us to release the Game on a particular date, in a particular region or with particular features.
Release dates, platforms, features, content and art shown on the Website – including development screenshots – are subject to change.
Any pre-registration or launch rewards will be described with their own eligibility rules when announced and are delivered in the Game.

5. Virtual currency & items

The Game may include virtual currencies (such as coins and diamonds) and virtual items (such as runes, sigils, artifacts, chest keys and hero upgrades) (“Virtual Items”).

Virtual Items are licensed to you, not sold. They have no monetary value, cannot be redeemed for real money or anything of value outside the Game, and may not be sold, traded or transferred except where the Game expressly allows it.
We may manage, rebalance, modify or remove Virtual Items and game mechanics to keep the Game fair and enjoyable. Run-based upgrades such as boons reset at the end of each run by design.
Virtual Items may be lost if your account is terminated for breaching these Terms or if the Services are discontinued, subject to applicable law.

6. Purchases & refunds

In-game purchases are processed by the Apple App Store or Google Play under their terms and payment methods. Prices are shown in the store before you buy and may include applicable taxes.
All purchases are final except as required by applicable law or the refund policies of the store you purchased from. Refund requests are handled by Apple or Google.
If you are a consumer in the EEA or UK, you agree that digital content is supplied immediately after purchase, and you acknowledge that you therefore lose your right of withdrawal once supply begins.
Parents and guardians can use device and store controls to restrict purchases.

7. Rewarded ads

The Game may offer optional advertisements that you can choose to watch for in-game rewards. Ad availability can vary by region and device, and rewards are granted only when an ad is completed. Daily limits may apply.

8. Leaderboards, events & fair play

Leaderboards, the weekly Boss Raid and other events are offered for fun and may include in-game rewards delivered by in-game mail. We may change event rules, schedules and rewards.
We may verify scores, remove implausible or suspicious results, and withhold or reclaim rewards obtained through cheating, exploits, automation or other breaches of these Terms.
Support heroes you lend can be borrowed by other players. Lending rewards are granted as described in the Game.

9. Code of conduct

You agree not to:

cheat, use bots, macros, modified clients, emulators intended to gain an unfair advantage, or exploit bugs;
hack, decompile, reverse engineer, or interfere with the Services, servers or networks, except where the law expressly allows it;
buy, sell or trade accounts or Virtual Items outside the Game;
harass, threaten or impersonate others, or use offensive or unlawful player names or content;
use the Services for any commercial purpose without our written permission; or
break any applicable law or encourage others to break these Terms.

Please report bugs and exploits to [email protected] instead of using them.

10. Your content & feedback

You keep ownership of content you create, such as player names and messages, but you grant us a worldwide, royalty-free licence to host, display and use it as needed to operate the Services. If you send us ideas or feedback, we may use them without obligation to you.

11. Intellectual property

The Services – including the Kingsguard TD: Heroes & Magic name, logos, heroes, characters, artwork, music, software and text – are owned by Advisory Apps Sdn. Bhd. or its licensors and are protected by intellectual property laws. Media and creators may use assets from our press kit for editorial coverage. Any other use requires our prior written permission.

12. Third-party services

The Services may integrate or link to third-party services such as app stores, advertising networks, analytics providers and social platforms. Your use of those services is governed by their terms, and we are not responsible for them.

13. Updates & availability

We may update, patch, modify, suspend or discontinue all or part of the Services at any time, including to add or remove content, adjust balance or perform maintenance. Some features require an internet connection and may not be available in all regions. If we permanently discontinue the Game, we will give reasonable advance notice where required by law.

14. Suspension & termination

You may stop using the Services at any time and may request deletion of your account. We may suspend or terminate your access, remove Virtual Items or reset progress if you breach these Terms, if required by law, or to protect players and the Services. Where appropriate, we will tell you the reason and give you a chance to respond.

15. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted or error-free. Nothing in these Terms excludes rights you have as a consumer that cannot be excluded by law.

16. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the twelve months before the claim or USD 100. These limits do not apply to liability that cannot be limited by law, such as for death or personal injury caused by negligence or for fraud.

17. Indemnity

To the extent permitted by law, you agree to indemnify us against claims, losses and expenses arising from your breach of these Terms or misuse of the Services.

18. Governing law & disputes

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve the issue informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live and may bring proceedings in your local courts.

19. Apple App Store terms

If you downloaded the Game from the Apple App Store, you also acknowledge that:

these Terms are between you and us only, not Apple, and we – not Apple – are solely responsible for the Game and its content;
Apple has no obligation to provide maintenance or support for the Game;
to the extent any warranty applies and the Game fails to conform, you may notify Apple for a refund of the purchase price (if any), and Apple has no other warranty obligation;
Apple is not responsible for addressing claims relating to the Game, including product liability, legal or regulatory compliance, consumer protection or intellectual property infringement claims;
you are not located in a country subject to a US Government embargo or listed on any US Government restricted-parties list; and
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. Changes to these terms

We may update these Terms from time to time, for example when the Game launches or new features are added. We will update the effective date above and, for material changes, notify you in the Game or by email before they take effect. Continuing to use the Services after the changes take effect means you accept the updated Terms.
